Rancourt Roofing understands that roofing terms can be confusing to people who are unfamiliar with the industry. This page should help clarify some of these terms and allow you to make an informed decision concerning your reroofing needs.

**Rancourt Roofing does not remove or reinstall solar panels. Please make arrangements prior to the installation date to have them removed and reinstalled.

Terms and Conditions

This proposal incorporates by reference the attached Additional Terms and Conditions. A 25% deposit is required prior to the start of the work being done and the balance is payable immediately upon completion of the roof. A monthly interest rate of 2% will be charged on any outstanding amount owed to the company. Warranty for workmanship: 10 years.

ADDITIONAL TERMS & CONDITIONS

These additional terms and conditions supplement the terms and conditions of the contract proposal attached hereto between Rancourt Roofing Inc. (“Rancourt Roofing”) and the “Client”. In the event of a conflict between the terms and conditions set forth herein and those of the contract proposal, the terms and conditions of the contract proposal shall prevail.

Acceptable Payment Methods: Personal cheques, Visa and MasterCard credit cards, money orders and cash are accepted. Cheques must be made payable to Rancourt Roofing Inc. There will be a $50 fee for each cheque returned due to insufficient funds. If paying by cash, arrangements for cash to be picked up must be made directly with Luc or Gaetan Rancourt.

Client Obligations: The Client is responsible for relocating and protecting their goods and chattels, fixtures and equipment, including but not limited to, vehicles, patio furniture, BBQs, air conditioners, fragile items on the roof, interior ceilings, interior or exterior walls, etc. The Client is also responsible for providing safe and clear access to the work site. Client agrees not to directly engage any Rancourt Roofing employees for roofing-related services.

Warranty: Rancourt Roofing warrants that it will perform the work specified in this contract in a professional and workmanlike manner in accordance with generally accepted industry standards and this contract. Rancourt Roofing warrants its workmanship for a period of 10 years after the date of completion of the work. This warranty only applies if Rancourt Roofing has received full payment from the Client under this contract. This warranty is also contingent upon the Client taking all reasonable precautions in maintaining the roof, including periodic caulking and snow and ice removal in heavy build-up situations. Rancourt Roofing’s warranty does not cover Client-supplied materials. Rancourt Roofing’s warranty is voided if its product installation is tampered with in any way by anyone other than Rancourt Roofing as a result of, but not limited to: snow and ice removal, installation of vents, heating cables, satellite dishes and other installations or repairs. There is no warranty on caulking work. The Rancourt Roofing warranty is transferable. For clarity, all warranties for products and materials are between the Client and the manufacturer, and not Rancourt Roofing.

EXCEPT AS EXPRESSLY SET FORTH IN THIS CONTRACT, RANCOURT ROOFING DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY RANCOURT ROOFING, ITS EMPLOYEES AND AGENTS SHALL IN ANY WAY INCREASE THE SCOPE OF THIS WARRANTY.

Exclusions: Rancourt Roofing assumes no responsibility for damages and/or losses caused to the Client’s property during the construction, including but not limited to, fixtures, wall hangings, walls, ceilings, cracks, fallen chandeliers or furniture as a result of Rancourt Roofing’s activities (e.g. hammering, removal/demolition of materials and structures, loading and installing new materials and structures, etc.). Rancourt Roofing will take reasonable measures to limit the potential damage to driveways, but due to the nature of the business and the necessary use of heavy machinery such as boom trucks, large vehicles, dump trailers, skids of shingles and other heavy materials, Rancourt Roofing cannot accept responsibility for any damage done to driveways surfaced with asphalt, concrete, interlock or other similar paving materials. Rancourt Roofing will not be responsible for soffit air intake blockages due to insulation or other materials that result in condensation forming underneath the roof deck and ice buildup. Rancourt Roofing is not responsible for damage to Client-owned items including but not limited to, vents, skylights, eaves troughs, siding, flashing, etc. where the Client requires reinstallation of such items by Rancourt Roofing.

LIMITATION OF LIABILITY: RANCOURT ROOFING WILL NOT BE LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR INDIRECT DAMAGES, INCLUDING BUT NOT LIMITED TO, ANY LOSS OF REVENUES, LOSS OF PROFITS OR LOSS OF GOODWILL, EVEN IF RANCOURT ROOFING HAS BEEN ADVISED OF THEIR POSSIBILITY. IN NO EVENT WILL RANCOURT ROOFING’S AGGREGATE CUMULATIVE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THIS CONTRACT EXCEED TWO MILLION DOLLARS ($2,000,000.00).

Force Majeure: Rancourt Roofing shall not be liable for any failure or delay on account of severe weather conditions including but not limited to high wind storms, hail storms, blowing snow and extremely heavy rainstorms, strikes, riots, insurrection, fires, explosions, acts of God, war, governmental action, labor conditions, material shortages, or any other cause which is beyond the reasonable control of Rancourt Roofing.

Notices: The Client agrees to provide Rancourt Roofing with written notice of any complaint covering Rancourt Roofing’s workmanship and to provide Rancourt Roofing with a reasonable chance to investigate the claim and attempt to resolve the matter, provided that the matter is covered by Rancourt Roofing’s warranty. If the Client alters or repairs, or has altered or repaired on its behalf, any item(s) of concern without first providing such prior written notice to Rancourt Roofing and giving reasonable opportunity to Rancourt Roofing to address the item of concern, then the Client will be deemed to have waived any and all claims against Rancourt Roofing with respect to item(s) of concern.

Subcontractors: Rancourt Roofing may use subcontractors to fulfill its obligations under this contract. Rancourt Roofing shall remain responsible to the Client under this contract for services performed by subcontractors.

Assignment: Rancourt Roofing may assign this contract without Client’s consent if Rancourt Roofing is acquired by a third party.
